By accessing and using StayStream ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

StayStream provides a hotel revenue management platform that includes:

• Performance analytics and reporting
• AI-powered insights and recommendations
• Multi-property portfolio management
• Automated report processing
• Team collaboration features

3. Account Terms

You must be 18 years or older to use this Service. You are responsible for maintaining the security of your account and password. StayStream cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. Payment Terms

• Subscription fees are based on the number of properties in your organization
• Free trial period may be offered with credit card required
• Billing is handled through our payment processor
• Prices are subject to change with 30 days notice
• No refunds for partial billing periods

5. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Transmit any malicious code or viruses
• Attempt to gain unauthorized access to any portion of the Service
• Impersonate another person or entity
• Use the Service for any illegal or unauthorized purpose

6. Data Rights and Usage

You retain all rights to your hotel performance data. By using the Service, you grant StayStream a worldwide, royalty-free license to:

• Process and analyze your data to provide the Service
• Create aggregated, anonymized datasets for industry benchmarking
• Develop and improve our algorithms and services
• Generate industry insights and reports using anonymized data

StayStream may commercialize aggregated and anonymized data derived from the Service, provided that such data cannot be traced back to any individual property or organization.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by StayStream and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

9. Limitation of Liability

In no event shall StayStream, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
